A persistent myth in real estate investing suggests that hard money lending operates like some sort of unregulated ‘Wild West’. Inexperienced investors assume that the hard money industry is built on a shadow market driven by predatory practices and firms that act more like loan sharks than licensed lenders. The myth is fueled by the fact that asset-based hard money lenders are not subject to the same regulations and red tape that make conventional banking so cumbersome.
Fortunately, the reality is far different. Responsible hard money lenders in Utah, particularly those operating as licensed firms, operate inside a structured framework of state statutes, regulatory standards, and legal contract law that protects financial systems and real estate transactions alike.
Statutory Regulation and Oversight
The states all regulate hard money lending in their own ways. I am using Utah as an example for purposes of illustration. Hard money lenders in Utah do not operate in a vacuum. They are regulated and subject to government oversight based on their corporate structures and loan focus.
1. Utah Division of Real Estate (DRE)
The Utah DRE is responsible for enforcing the Utah Residential Mortgage Practices and Licensing Act. Private lenders underwriting loans secured by 1-4 family residential properties must adhere to statutory licensing under this act – even if the loans are used for commercial or business purposes. Lenders must also adhere to disclosure and operational standards.
2. Utah Department of Financial Institutions (DFI)
Utah’s DFI is tasked with governing mortgage lending practices under Title 70D of the state’s code. Among other things, the department ensures that non-depository commercial lenders are properly registered, maintains sound financial practices, and complies with all applicable regulations.
3. Nationwide Multistate Licensing System (NMLS)
The NMLS is a legally recognized entity through which non-depository financial services obtain state-required licensing or registration. At last count, sixty-seven government entities in the U.S. and its territories participate. The system is used by fifty-nine state agencies to handle licensing, while fifty-six use the system to manage licensing among non-bank entities, like consumer debt services and money service businesses.
Technically, a single individual with enough wealth could lend out his money on a private basis without being licensed or subject to DRE and DFI oversight. But such private lenders are the rare exception to the rule. Most hard money lenders in Utah are like Salt Lake City’s Actium Lending. They are licensed and regulated by state authorities.
Protection Against Predatory Practices
The primary purpose of regulating financial institutions and private lenders is to prevent predatory lending practices. That certainly applies to hard money lenders in Utah. State statutes directly restrict deceptive or predatory lending in two ways:
- Transparency – Private lenders are not allowed to obscure exorbitant fees in contract language. They are not allowed to adjust terms at closing. The combination of Utah contract law and real estate regulations requires total transparency on everything from origination points to maturity dates to interest and closing costs.
- Fraud and Misrepresentation – Private lenders in Utah are fully accountable to existing fraud, contract, and usury laws. Any form of deceptive practice, including intentionally misleading borrowers or falsifying terms, opens a private lender to civil litigation and administrative fines. Loss of an operating license is also possible.
If you have long believed the myth that hard money lenders in Utah are unregulated and predatory, it is time to adjust your thinking. Likewise for hard money lenders across the country. Hard money is a legitimate business that provides a much-needed service to certain types of borrowers, particularly real estate investors. Everything is legal, above board, and regulated.
